This document outlines the rules and regulations for the use of the North Kitsap Schools Foundation’s Website, located at www.nkschoolsfoundation.org.

By accessing this website, we assume you accept these terms and conditions. Do not continue to use the North Kitsap Schools Foundation website if you do not agree to take all of the terms and conditions stated on this page.

1. Donations and Sustaining Donor Plans

One-Time Donations

All one-time donations are processed immediately upon checkout. You will receive an email confirmation and a receipt for tax purposes (where applicable).

Sustaining Donor Plans

Agreement

By enrolling in a Sustaining Donor Plan, you authorize the North Kitsap Schools Foundation, through its integrated payment processing service managed by Wix.com, to automatically charge your designated payment method for the agreed-upon donation amount on a recurring basis (e.g., monthly, quarterly) as specified during checkout.

Nature of Donation

You acknowledge that payments made under the Sustaining Donor Plan are charitable donations. While the Foundation may occasionally offer perks, recognition, or benefits to Sustaining Donors, these are gratuitous gestures of appreciation and are not guaranteed. They do not constitute a contract for services or goods. Benefits are subject to change or withdrawal at any time without notice.

Billing Cycle

The sustaining donation will automatically renew at the end of each billing cycle unless you cancel it.

Modification and Cancellation

You may modify or cancel your Sustaining Donor Plan at any time by logging into your donor account on our website or by contacting us directly at contact@nkschoolsfoundation.org. Cancellation requests must be received at least seven (7) business days prior to your next scheduled billing date to take effect before that payment is processed. Cancellation stops future charges but does not entitle you to a refund of previously processed donations.

Refused Charges

If a recurring charge is refused or declined, we will attempt to notify you and may retry the charge once before suspending the plan.

Refund Policy

All donations, whether one-time or recurring, are considered final and non-refundable. If you believe an error has occurred with your payment, please contact us immediately at contact@nkschoolsfoundation.org so we can review the transaction.

2. User Accounts and Security

Account Creation

To access specific features of the Website, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

Account Security

You are responsible for safeguarding your password. You agree that you will not disclose your password to any third party and that you will take sole responsibility for any activities or actions under your account, whether or not you have authorized such activities. You must immediately notify the North Kitsap Schools Foundation of any unauthorized use of your account.

Termination

We reserve the right to suspend or terminate your account at our sole discretion if we believe you have violated these Terms and Conditions or engaged in unauthorized use of the Website.

3. Account Tiers and Access Rights

Basic User Accounts

Users who create an account but do not hold an active "Sustaining Donor Plan" are classified as Basic Users. Basic User accounts are limited in functionality. As a Basic User, your account access is restricted to the management of your newsletter subscription preferences only.

Sustaining Donor Accounts

Users who enroll in a verified Sustaining Donor Plan (as outlined in Section 1) are classified as Sustaining Donors. Sustaining Donor accounts are granted expanded access to the Website, which may include access to donor history, exclusive content, expanded profile management features, and other benefits as determined by the Foundation.

Loss of Status

If a Sustaining Donor cancels their plan or if a payment fails and is not rectified, the account will automatically revert to Basic User status at the end of the current billing cycle.

4. Electronic Communications and Newsletter

Automatic Subscription

By creating an account on the North Kitsap Schools Foundation website, you automatically consent to subscribe to our monthly newsletter and receive electronic communications from us regarding Foundation news, updates, and events.

Managing Subscriptions

Basic Users

You may manage your newsletter preferences or unsubscribe at any time by logging into your account or by clicking the "unsubscribe" link located at the bottom of our emails. However, opting out of the newsletter will not terminate your website account.

Sustaining Donors

In addition to newsletter preferences, Sustaining Donors may receive transactional emails regarding their donation status, which are required for tax and administrative purposes and cannot be opted out of.

5. Intellectual Property Rights

Unless otherwise stated, the North Kitsap Schools Foundation and/or its licensors own the intellectual property rights for all material on www.nkschoolsfoundation.org. All intellectual property rights are reserved. You may access this from www.nkschoolsfoundation.org for your own personal use, subject to restrictions set in these terms and conditions.

You must not:

Republish material from www.nkschoolsfoundation.org.
Sell, rent, or sub-license material from www.nkschoolsfoundation.org.
Reproduce, duplicate, or copy material from www.nkschoolsfoundation.org.
Redistribute content from the North Kitsap Schools Foundation (unless the content is specifically made for redistribution, e.g., shareable educational resources).

6. User Contributions and Comments

This Website may offer users the opportunity to post and exchange opinions and information. The North Kitsap Schools Foundation does not filter, edit, publish, or review Comments before their presence on the website. Comments reflect the views and opinions of the person who posts them.

By posting Comments, you warrant and represent that:

You are entitled to post the Comments on our website and have all necessary licenses and consents to do so.
The Comments do not invade any intellectual property right, including, without limitation, copyright, patent, or trademark of any third party.

The North Kitsap Schools Foundation reserves the right to remove any Comments that can be considered inappropriate, offensive, or cause breach of these Terms and Conditions.

The following organizations may link to our Website without prior written approval:

Educational institutions (e.g., schools, districts) for non-commercial purposes;
System-wide Accredited Businesses.

We may approve link requests from other organizations if we decide that the link would not make us look unfavorably on ourselves or on our accredited businesses.
